Right to rectification

    7. If one of the above-mentioned reasons applies and a data subject wishes to have personal data stored by TesT GmbH erased, he or she can contact an employee of the data controller at any time. The employee of TesT GmbH will arrange for the request for erasure to be complied with immediately.
    8. If the personal data has been made public by TesT GmbH and our company, as the person responsible, is obliged to erase the personal data pursuant to Article 17(1), TesT GmbH shall take appropriate measures, including technical measures, taking into account the available technology and the implementation costs, to inform other persons responsible for data processing who process the published personal data, that the data subject has requested the erasure of all links to these personal data or of copies or duplications of these personal data by these other persons responsible for data processing, insofar as the processing is no longer necessary. The employee of TesT GmbH will make the necessary arrangements in individual cases.

    If the personal data have been made public by BEWO Oberpfaffenhofen GmbH and if our company, as the person responsible, is obliged to erase the personal data pursuant to Article 17(1), BEWO Oberpfaffenhofen GmbH shall take appropriate measures, including technical measures, taking into account the available technology and the implementation costs, to inform other persons responsible for data processing who process the published personal data, that the data subject has requested that these other persons responsible for data processing delete all links to this personal data or copies or duplications of these personal data, insofar as such processing is no longer necessary.

     

    Right to restriction of processing

    The data subject shall have the right to obtain from the controller restriction of processing where one of the following applies:

      1. The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal dat
      2. The processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead.
      3. The controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment exercise or defence of legal claims.
      4. The data subject has objected to processing pursuant to Article21(1) pending the verification whether the legitimate grounds of the controller override those of the data subject.

       

      Right to data portability

      The data subject shall have the right to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from BEWO Oberpfaffenhofen GmbH to which the personal data have been provided, where:

        1. The processing is based on consent pursuant to point (a) of Article 6(1) or point (a) of Article 9(2) or on a contract pursuant to point (b) of Article 6(1); and
        2. The processing is carried out by automated means.

         

        Right to object

        The data subject shall have the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her which is based on point (e) or (f) of Article 6(1), including profiling based on those provisions.

        In the event of an objection, BEWO Oberpfaffenhofen GmbH will not process your data further, unless there are legitimate grounds for BEWO Oberpfaffenhofen GmbH to override your interests, rights and freedoms or the processing serves to assert, exercise or defend legal claims.

        Legal basis for processing

        The processing of personal data is based on the legality described in Article 6. Primarily for the fulfilment of a contract with the data subject (point (b) of Article 6(1)) or by consent of the data subject to the processing of his or her personal data (point (a) of Article 6(1)).


        Automated decision-making

        The data subject shall have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or similarly significantly affects him or her. This shall not apply if the decision (1) is necessary for entering into, or performance of, a contract between the data subject and a data controller; or (2) is authorised by Union or Member State law to which the controller is subject and which also lays down suitable measures to safeguard the data subject’s rights and freedoms and legitimate interests; or (3) is based on the data subject’s explicit consent.

        If the decision (1) is necessary for the conclusion of a contract between the data subject and the data controller or (2) is taken with the express consent of the data subject, BEWO Oberpfaffenhofen GmbH shall implement suitable measures to safeguard the data subject’s rights and freedoms and legitimate interest, at least the right to obtain human intervention on the part of the controller, to express his or her point of view and to contest the decision.
